Try Before You Buy (TBYB) – Terms & Conditions

By using Avari’s Try Before You Buy (“TBYB”) program, you agree to these Terms & Conditions in addition to those set out by Mirra.

1. Eligibility

TBYB is available to new Avari customers only.

A new customer is defined as someone who has not previously:

  • Purchased an Avari breast pump (including via TBYB), or
  • Participated in the TBYB program

We reserve the right to:

  • Verify eligibility
  • Refuse, cancel, or limit participation at our discretion

2. Trial Period

The trial period:

  • Begins on the date the order is marked as delivered on our systems
  • Is specified at checkout

At the end of the trial period, you must either:

  • Return the product in accordance with these terms, or
  • Retain the product, in which case the full purchase amount will be charged

3. Returns & Fees

If you choose to return the product:

  • A $49 restocking fee applies
  • Return shipping costs are the responsibility of the customer
  • Original shipping fees (if any) are non-refundable
  • Items must be returned within 3 days of the trial period ending

If the product is not returned within this timeframe, Avari reserves the right to charge the full retail price of the product.

4. Condition of Returned Items

Returned items must:

  • Include all original components, parts, and accessories
  • Be returned in good condition, with no damage beyond reasonable trial use
  • Be cleaned, emptied, and free from milk residue

If a return is:

  • Incomplete
  • Damaged
  • Excessively worn
  • Unsanitary

Avari reserves the right to:

  • Refuse the return, and/or
  • Charge additional fees up to the full product value

5. Hygiene & Product Use

Due to the personal and hygienic nature of breast pumps:

  • Products must be used strictly in accordance with provided instructions
  • Improper use, failure to clean appropriately, or unsafe handling may result in:
    • Return refusal
    • Additional charges

6. Charges & Authorisation

By placing a TBYB order, you authorise Avari (via Mirra) to charge your payment method for:

  • The full product price if:
    • The item is not returned within the required timeframe
    • The return does not meet the required condition standards
  • Any applicable fees, including:
    • Restocking fee
    • Damage, replacement, or missing component costs

7. Discounts & Promotions

TBYB orders:

  • Cannot be used in conjunction with promo codes, discounts, or store credits

If a discount is applied due to:

  • System error
  • Technical issue

Avari reserves the right to:

  • Reverse the discount
  • Charge the correct TBYB amount

8. Loss, Theft & Responsibility

You are responsible for the product during the trial period.

If the product is:

  • Lost
  • Stolen
  • Damaged

Avari reserves the right to charge the full retail value of the product.

We strongly recommend using tracked shipping for all returns.

9. Fair Use & Misuse

TBYB is intended for genuine product evaluation.

Avari reserves the right to:

  • Refuse or cancel orders
  • Limit quantities (e.g. one TBYB per household)
  • Restrict future access

Where we suspect:

  • Misuse
  • Abuse
  • Excessive or repeated returns
  • Fraudulent activity

10. Product Availability

TBYB is available on selected products only and may be withdrawn at any time without notice.

11. End of Trial

If the product is not returned before the trial period ends:

  • The full purchase amount will be automatically charged
  • The order will be treated as a final sale
  • Standard Avari return policies will apply from that point onward

12. General

These Terms are governed by the laws of Australia.

Avari reserves the right to update or amend these Terms & Conditions at any time.
